How knowing existing registered trademarks can save you money $$$
Starting a new business? Heck yeah! Go forth and crush it! Change the world! But before you change the world for yourself and those impacted by your brand, lets take steps to make sure you won’t have to RE-BRAND, get slapped with a cease & desist, or sued for trademark infringement. SHEW that was a lot right?
Okay Seesh, get to the point, how can knowing existing registered trademarks help me avoid these pitfalls??
Knowing existing registered trademarks can make sure you don’t open up your new brand with a name that is already protected nationwide by a federal trademark.
So can you just look up existing businesses on the USPTO TESS system? Yes you can! BUT WAIT. there’s more…
Let’s say you find a brand name that is registered and your heart drops because you were so set on this brand name, maybe you’ve even already started using it. Sad panda. There is another step in this process which is scrutinizing whether that brand and your brand will overlap or a consumer would reasonably believe the products could be from the same company. After all, trademarks at their core are source identifiers.
Let’s say the brand name is AB123 and the registered brand sells pencils and you want to sell car tires. These markets are completely different so you may be in the clear to use the same brand name after all! This search is something you can do on your own without a lawyer but of course we suggest a trademark lawyer to help you through evaluating your mark and all other potential marks.
